CONVEYANCING

This practice handles all type of sale and purchase transaction ranging from conventional retail properties, commercial properties to lands deal as well as post auction sale transaction namely private treaty sale by way of public auctions, public auctions by the High Court and public auctions by the Land Office.

GENERAL LITIGATION

This practice, which covers a wide spectrum of civil litigation areas, include all matters pertaining to contract and commercial disputes, tort law (including defamation, trespass, conspiracy etc.), real estate (land ownership and/or interest) disputes, landlord and tenant disputes, partnership law, trusts law, wills, probate and succession matters, non-banking debt recovery actions and quasi contract.

Some of the pre-judgment or interlocutory matters undertaken by this practice include urgent applications for injunctive relief (including prohibitory, mandatory, Mareva, Anton- Pillar or Erinford orders), mandatory orders under the Specific Relief Act 1950, matters pertaining to the lodgement or removal of private caveats and pre-trial judgment or orders. Post-judgment enforcement of judgment or orders are also handled by this practice, which include registration of foreign judgments and/or commencement of civil proceedings for the enforcement of the same. In this regard, the lawyers in this practice have significant trial and appellate experience and the appellate matters handled by this practice include the lodgement and conduct of civil appeals to the High Court, Court of Appeal and the Federal Court of Malaysia and all other matters in relation thereto.

BANKING LITIGATION

This practice covers the intricacies of the execution process of recovery by way of foreclosure proceedings via public auction for property held under Registry Title and Land Office Title as well as public auction by way of private treaty sale.

EMPLOYMENT, LABOUR & INDUSTRIAL RELATIONS

This practice specialises in handling all matters relating to labour, employment and industrial relations which include matters in the Malaysian Labour Court, Industrial Court and proceedings therefrom to the High Court, Court of Appeal and Federal Court. Owing to the particular demands of Malaysian Industrial Law, the predominant representation of this practice is for and on behalf of the employer although save for the occasions where we may act for the employee strictly on a case to case basis.

The advisory aspects of this practice include advise on the preparation, convening and conduct of domestic inquiries, dismissals and termination of employment and the drafting and vetting of employment contracts as well as all matters relating to the transfer, secondment, suspension and retirement of employees.

One aspect of this practice which appears to be in demand with Companies is its ability to provide corporate or business start-up consultancy services which include the drafting and preparation of Contracts of Employment, formulation of In- House HR practices and procedures in the form of Employee Handbooks or Manuals, Intellectual Property & Confidentiality Agreements, Employee’s Computer, Internet & Electronic-Mail Usage Regulations, regulation, implementation and control of In- House Disciplinary Procedures and Codes of Conduct and Ethics at the Workplace to name a few.

Further, in view of the ever increasing need for protection of the Employer’s intellectual property rights, this practice also frequently advises and handles matters pertaining to enforcement of such rights (e.g trade secrets, confidential information and know-how protection) including seeking injunctive relief to protect, preserve and secure such intellectual property and/or to prevent unauthorised disclosure, dissemination and usage of the same.

INSURANCE & PROFESSIONAL INDEMNITY

This practice handles all non-personal injury insurance litigation matters including policy claims, insurance fraud, repudiation, non-disclosure, life and property insurance disputes, both from the advisory and court-proceedings aspect.

The lawyers in this practice also provide advisory services and handle litigation on professional indemnity claims, which include professional negligence matters (e.g solicitor’s negligence) and associated matters thereto as well as matters relating to the insurance industry and regulatory issues in the context of the Financial Service Act 2013.

PROBATE & ADMINISTRATION OF ESTATES

This practice is involved in the drafting and execution of wills and petitions to the High Court for Grants of Probate and all forms of Letters of Administration. The department advises executors and administrators of estates on all matters arising in the administration of estates and assists in the transmission and transfer of assets of the estate.

As a complement to the General Litigation practise, this practice also handles both contentious and non-contentious probate matters in the High Court which include forgery and/or invalidity of wills, fraud, negligence and/or misconduct on the part of the executor or administrator and distribution of estates.
